概要

  米国における国際訴訟は、その件数が多いのは勿論、分野においても非常に多岐にわたっています。最近では、輸入差止めを目的とした米国際貿易委員会（ITC）訴訟が頻繁に提起されており、日本企業も積極的にITC訴訟を考慮するなどの変化も起こりつつあります。
  今回のセミナーではそのITCに関する訴訟の実例と新たなる展開について、米国での特許や知的財産に関する訴訟で豊富な経験と高い実績をお持ちのFish&Richardson　P.C.のニューヨーク事務所よりBrian D. Coggio弁護士とMichael Siem弁護士をお招きして講演して頂きます。また、ディスカバリーでの実例を紹介することによりEディスカバリーについての新たな展開についてもお話を頂きます。

Brian D. Coggio弁護士

Mr. Coggio is a Senior Principal in the New York office of Fish & Richardson. He has extensive law firm experience as a senior trial attorney and counselor and has litigated disputes across a wide range of technologies with a particular focus in chemical, pharmaceutical, and biotechnology. Mr. Coggio is currently lead counsel for Hoffmann-La Roche representing them in a patent litigation suit involving Xeloda ®, a drug to treat cancer invented by scientists at Nippon Roche, now Chugai Pharmaceuticals. He also has experience representing Japanese pharmaceutical companies, including Tanabe Seiyaku, in patent litigation. He has also been involved in cases before the International Trade Commission and in various foreign countries including Germany, Great Britain, Switzerland, Italy, and the Netherlands. In addition, Mr. Coggio has also represented clients in numerous cases under the Hatch-Waxman Act and has written and lectured extensively on this topic in this country, Europe, Canada and Japan. Mr. Coggio is currently Adjunct Professor of Law at Fordham University School of Law where he teaches patent litigation.

Michael A. Siem弁護士

Mr. Siem is Of Counsel in the New York office of Fish & Richardson. His practice includes intellectual property litigation with a focus on patents. Over the last several years, Mr. Siem has appeared before various federal district courts and litigated cases in many technological areas including pharmaceuticals, chemical processes, and biotechnology. Mr. Siem's practice has focused primarily on pharmaceutical litigation related to the Hatch-Waxman Act. In addition to his Hatch-Waxman practice, he has also litigated cases in various technologies including silica sols, potential anticancer drugs, agriculture and medical devices. Mr. Siem's practice includes representation of both patentees and alleged infringers. However, in relation to Hatch-Waxman litigation Mr. Siem limits his representation to branded drug manufacturers. Mr. Siem's experience encompasses every aspect of litigation, beginning with the pre-suit investigation and continuing through trial. Mr. Siem has also been involved in the preparation of patent validity and infringement opinions, as well as drafting license agreements. Mr. Siem has experience handling various pro bono matters, and he was a recipient of the 2008 Thurgood Marshall Award for Capital Representation given by the Committee on Capital Punishment of the Association of the Bar of the City of New York.

David Yaegashi ロー・クラーク

Mr. Yaegashi joined the New York office of Fish & Richardson in 2009. His current engagements include patent litigation matters involving representation of a Japanese automotive company, and a US pharmaceutical company. Mr. Yaegashi is from Japan, and previous to starting his law career worked in Tokyo for a multinational insurance company, where he managed complex projects involving M&A and Business Process Reengineering.
