概要

  2010年に入り、日本企業の米国における法的リスクは益々大きくなりつつあると言えます。
  アンチカルテル、PL等に関する当局の大型調査の頻発。増加の一途をたどる知財訴訟。いまや米国でビジネスを展開するあらゆる企業は、このような法的リスクに常にさらされているといえるでしょう。
  そしてそのような訴訟の中でも、昨今非常に注目が高まっているのがITC（米国国際貿易委員会）に関する訴訟です。
  ITCにおけるケースはこの10年の間、着実に増加しています。2000年には11件だったところから2010年度は既に45件の新たなケースがファイルされ、今後も増加することが予想されます。
  このセミナーは特許訴訟に関して全米トップの実績を持つカークランド・エリス法律事務所（KIRKLAND & ELLIS LLP）から2名の弁護士をお招きし、ITC特許訴訟および、ITC特許訴訟と密接に関係する米国地方裁判所における戦略に関して講演していただきます。
  また株式会社UBICからは、実際に訴訟が発生した際に必要となる電子証拠開示（Eディスカバリ）の手順及び注意点をご紹介します。さらに、社内における事前対応体制の構築に関しても講演いたします。実際どのような点に留意して体制構築を行えば有効なのかという点を、豊富な訴訟支援の経験に基づいてご紹介します。

Paul R. Steadman 弁護士 （KIRKLAND & ELLIS　LLP）

Paul R. Steadman is a partner in the Chicago and Washington D.C. offices of Kirkland & Ellis LLP. Described by Legal500.com as 'an outstanding IP litigator,' the 2010 review noted that 'even though he is relatively young, has already amassed great experience in many aspects of patent disputes such as depositions, settlement negotiations and trials'. He was also recently chosen as one of the 2009 "40 under forty" attorneys in Illinois by the Law Bulletin Publishing Company. Paul works primarily on complex patent, trade secret, trademark, copyright and other IP-related litigation matters. He has been trial counsel to clients in jury trials, Federal and state court appeals, Markman and other evidentiary hearings, mediations, and arbitrations. He has a long record of representing Japanese companies, including DENSO CORPORATION, Hitachi, Ltd., Clarion Co., Ltd., Konica Minolta Holdings, Inc., Kubota Corp., Minolta Corp., Nichia Corp., Rohm Co., Ltd. and Nippon Electric Glass Co., Ltd.
He teaches and lectures regularly on topics relevant to United States IP law in Japan. He was a guest professor at Tokai University School of Law in 2006 and 2007, teaching the course "U.S. Patent Litigation." He gave a seminar in Osaka to 180 IP professionals entitled "Unique Aspects of Defending Japanese Companies in U.S. Patent Litigation: and using them to your advantage." In 2005-2007 and 2009, Mr. Steadman was a guest lecturer at the Japan Intellectual Property Association's Course D7, where he did a mock trial witness cross-examination. And in October 2004, Mr. Steadman was a guest lecturer to the Intellectual Property Senryaku Koryu Kaigi, Intellectual Property Jyuku and Patent Senryaku Staff Kaigi in Tokyo at a seminar sponsored by Kigyo Kenkyu Kai entitled "Preparing for the Possibility of U.S. Patent Litigation." He also speaks regularly in the United States, and has spoken every year since 1997 at the Annual Kirkland & Ellis Technology and Law Seminar.

William Devitt 弁護士 （KIRKLAND & ELLIS　LLP）

William Devitt is a partner in Kirkland's Intellectual Property group. Prior to joining Kirkland, Mr. Devitt worked for seven years as a communications engineer for the Central Intelligence Agency. Since joining Kirkland, Mr. Devitt has concentrated his practice in supporting high technology clients in litigation and transactional matters. Mr. Devitt's patent litigation practice has focused primarily in the electrical arts, in particular wireless communications, data networks, storage technologies, and semiconductors. On the transaction front, Mr. Devitt has considerable experience in representing and advising clients in connection with patent assertions and license agreements. Mr. Devitt also has a long record of representing Japanese companies, among them Hitachi, Ltd., Seiko Epson Corp., Konica Minolta Holdings, Inc., Rohm Co., Ltd. and Elpida Memory. Mr. Devitt was a guest professor at Tokai University School of Law in 2006, and assisted as a guest lecturer at the Japan Intellectual Property Association's Course D7in 2009.
