概要

  米国における国際訴訟は件数の増加とともに、分野においても非常に多岐にわたっています。また近年米国政府による調査が日本企業に対しても増えてきております。米国での調査や訴訟においては各種資料等の書面『Paper Discovery』による提出と、関係者が使用しているコンピュータやメディアに保存されているデジタルデータでの情報開示『e-Discovery』を要求される場合があり、2006年12月に米国連邦民事訴訟手続規則（FRCP）が改正されたことで、電子情報を要求される可能性が極めて高くなりました。
  また、昨今では米国のみならずアジア圏においても、日本企業が訴訟に巻き込まれるリスクは一層高まっています。
  今回のセミナーでは、米国でも国際訴訟に関する実績が特に豊富なMorgan, Lewis　& Bockius LLPからBenjamin P. Smith弁護士とLisa Tenorio-Kutzkey弁護士を招聘し、それぞれ「米国訴訟と国際仲裁」並びに「米国海外不正行為防止法（FCPA： Foreign Corrupt Practices Act）」にスポットを当てご講演頂きます。

Benjamin P. Smith　弁護士

Benjamin P. Smith is a partner in Morgan Lewis's Litigation Practice. Mr. Smith's practice focuses on complex commercial disputes, with a particular emphasis on business tort, fraud, breach of contract, and unfair competition cases. Mr. Smith also has an extensive background in products liability litigation and consumer class actions.
Recently, Mr. Smith successfully prosecuted breach-of-contract claims on behalf of a pharmaceutical firm in an international arbitration ranked, by amount in controversy, as one of the 30 largest of 2009 by the American Lawyer. Mr. Smith also obtained summary judgment against a public agency in a groundwater contamination case. In 2008, he helped obtain a defense verdict in a trade secret trial for a leading financial services firm. And, in 2006, Mr. Smith and his colleagues were named to the National Law Journal's "Defense Hot List" after obtaining a rare midtrial defense verdict for a technology client in a corporate opportunity and business tort action. Over the past several years, Mr. Smith has also successfully resolved a variety of business disputes and tort claims short of trial or arbitration.
Mr. Smith received his J.D., cum laude, from Harvard Law School in 1998. He received his A.B. in human biology and political science from Stanford University in 1995, where he graduated Phi Beta Kappa and with honors. Prior to joining Morgan Lewis, Mr. Smith was an associate for Brobeck, Phleger & Harrison LLP in San Francisco.
Mr. Smith is admitted to practice in California.

Lisa Tenorio-Kutzkey　弁護士

Lisa Tenorio-Kutzkey is a partner in Morgan Lewis's Litigation Practice. Ms. Tenorio-Kutzkey focuses her practice on the representation of corporations in civil and criminal antitrust litigation and the defense of individuals and companies in all phases of government investigation and prosecution.
Since joining Morgan Lewis in 2004, Ms. Tenorio-Kutzkey's practice has centered on conducting large-scale internal investigations and defending clients before the U.S. Department of Justice, the U.S. Attorneys' Offices, the SEC, and other government agencies.

Nick Gall　弁護士

Nick's principal practice areas are commercial litigation, fraud/asset tracing and insolvency.
He has acted for publicly listed companies, senior employees, the Hong Kong Government, the US Government, major international banks and corporations throughout Asia.
Nick has extensive experience in dealing with multi-jurisdictional fraud and international asset tracing litigation. His work often requires cross-border applications, freezing/gagging applications, urgent injunctive relief, the examination of senior executives /bank offices and recovery and enforcement proceedings generally. He also has extensive experience in forcing banks and financial institutions to provide information to assist in tracing and recovery of funds and fending off venture funds in respect to international sovereign debt recoveries.
